TERMS AND CONDITIONS OF SERVICE

Please read these Terms and Conditions ("Terms") carefully before you use any of our services, data, or products available through our website www.justdata.in or through any other communication channel like email, WhatsApp, or phone. These Terms create a legal agreement between you ("Client", "Buyer", or "you") and Justdata ("we", "us", or "our").

When you place an order, make a payment, or download data from us, it means you have fully read and agreed to all these Terms. If you do not agree, please do not use our services or make any payment.

We may update these Terms from time to time without giving prior notice. It is your responsibility to check these Terms regularly. If you continue using our services after any update, it means you have accepted the new Terms.

1. ABOUT JUSTDATA

Justdata is a fully online data services company. We do not have a physical office that is open to clients. All our work including orders, payments, client support, and data delivery happens online through email, cloud platforms, WhatsApp, and payment gateways.

We provide targeted B2B and B2C database and lead generation services to clients across India and globally. Our services are meant for businesses, sales teams, marketers, and professionals who need verified data for their marketing and business activities.

2. SERVICES WE OFFER

Justdata provides a wide range of targeted database and lead generation services. Our main service categories are:
  • Real Estate Database - leads of property buyers, sellers, investors, builders, brokers, and homebuyers. Data is available segment-wise by city, locality, budget, and property type.
  • Stock Market and Investment Database - leads of active investors, traders, demat account holders, mutual fund investors, HNIs (High Net Worth Individuals), and people interested in financial products.
  • Salaried Employee Database - data of salaried working professionals. Available segment-wise by industry, income range, company type, designation, and city.
  • Loan Seekers Database - leads of people and businesses who are actively looking for personal loans, home loans, business loans, vehicle loans, or credit cards.
  • B2B Database - business directories and contact data of decision-makers across different industries.
  • B2C Database - consumer data available segment-wise by demographics, location, interests, income group, and lifestyle.
  • Custom and Niche Databases - special data sets built as per the client's specific requirements, on request.
The exact scope, volume, format, and fields of data delivered will be decided at the time of placing the order. We reserve the right to modify or discontinue any service category at any time.

3. DATA SOURCE AND DISCLAIMER

All data and databases provided by Justdata are collected from publicly available sources on the internet. This includes but is not limited to public directories, business listing websites, social media platforms, government portals, public forums, classified advertisement websites, and other openly accessible online sources. We also source data through reputable third-party data providers who collect information from similar publicly available channels.

Justdata does not hack, steal, or obtain any data through unauthorized or illegal means. All information available in our databases was already publicly accessible on the internet at the time of collection.

Since the data originates from public and third-party sources, Justdata does not claim to be the original creator or owner of the underlying personal or business information contained in the databases. However, the compilation, arrangement, formatting, segmentation, and presentation of this data is the exclusive intellectual property of Justdata.

By purchasing data from us, you acknowledge and accept that:
  • The data has been sourced from publicly available internet sources and third-party providers.
  • Justdata is not responsible for the original accuracy, completeness, or currency of the information at the time it was publicly available.
  • Any changes in the personal or business details of individuals after the data was collected and compiled are beyond Justdata's control and knowledge.
  • Justdata makes no representation that the use of such publicly sourced data for marketing or commercial purposes is compliant with every law applicable to your specific industry, region, or use case. It is entirely your responsibility to ensure compliance.

4. WHO CAN USE OUR SERVICES

By using Justdata's services, you confirm that:
  • You are at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872.
  • You are using our data only for lawful business, commercial, or professional purposes.
  • You have the authority to enter into this agreement for yourself or your organization.
  • You will not use the data for anything that is illegal or unethical.
  • All the information you give us while placing an order is true and complete.
Justdata has the right to refuse service to anyone at any time without giving a reason.

5. HOW ORDERS WORK

All orders with Justdata are placed through direct communication via email, WhatsApp, phone, or any other digital channel that both parties agree on. We do not have a sign-up or login system on our website, so all orders are handled manually by our team.

An order is confirmed only when:
  • Full payment has been received by Justdata through any accepted payment method.
  • Our team has sent you a written or electronic confirmation via email or any other communication channel.
Just asking a question, requesting a sample, or having a conversation with us does not mean an order is confirmed. We will not deliver any data until full payment is received and confirmed.

If we find that a specific data category or filter requested by you is not available or cannot be delivered, we will let you know before accepting your payment and will offer you an alternative or a full refund for that particular order.

6. PAYMENT TERMS

All payments must be made in full and in advance before data is delivered. We do not offer credit, deferred payment, or installment options unless specifically agreed upon in writing by a senior person at Justdata.

6.1 Payment Methods We Accept

  • UPI (Unified Payments Interface)
  • Bank Transfer / NEFT / RTGS / IMPS
  • Net Banking (via payment gateway)
  • Digital Wallets (via payment gateway)
  • Credit Card (via payment gateway)
  • Debit Card (via payment gateway)

6.2 Currency and Pricing

All prices are in Indian Rupees (INR) unless stated otherwise in writing. Prices do not include any taxes or government charges. We may change our pricing at any time without prior notice. The price agreed at the time of your order confirmation will apply for that specific order.

6.3 Payment Security

Payments made through our payment gateway are processed by a third-party payment processor. Justdata does not store your credit card or debit card details on our systems. By making a payment, you also agree to the terms of the payment gateway provider.

6.4 Failed or Disputed Transactions

If a payment fails after money is debited from your account, please contact your bank or payment provider immediately. Justdata will not be responsible for delays or issues caused by payment gateway failures, bank errors, or network problems. Any refund for a genuinely failed transaction will follow the payment gateway's own refund process and timeline.

7. DATA DELIVERY

7.1 Delivery Timeline

After we receive and confirm your payment, we will deliver your data within 4 to 24 hours. This timeline can vary depending on the size and complexity of your order, any customization needed, and our team's availability at that time.

We will not be responsible for delays caused by:

  • Technical problems beyond our control like server downtime or internet outages.
  • Public holidays, weekends, or force majeure events.
  • Wrong or incomplete delivery details given by you.
  • Payment processing delays.

7.2 How We Deliver

We deliver data through one or both of the following methods:
  • Via Email - the data file is sent directly to your email address.
  • Via Cloud Download Link - a secure download link is shared with you to download the data file.
It is your responsibility to download and save the data within the validity period of the download link. If you fail to download the file before the link expires, Justdata is not obligated to resend the link or redeliver the data.

7.3 Data Format

Data is usually delivered in Microsoft Excel (.xlsx) or CSV (.csv) format, or any other format as agreed at the time of your order. If you do not specify a format, we will deliver in our standard format.

8. REFUND POLICY

JUSTDATA HAS A STRICT NO-REFUND POLICY. ALL SALES ARE FINAL.

Once your payment is received and your order is confirmed, no refund will be given under any circumstances. This applies in cases like:
  • You changed your mind or your business plan after placing the order.
  • You are not satisfied with data quality but the issue does not qualify under our Replacement Policy in Section 9.
  • You did not use the data after purchasing it.
  • You made an accidental or duplicate payment (except in proven cases as covered in Section 8.1).
  • Your target audience or requirements changed after the order was confirmed.
  • You faced technical difficulty on your end in opening or using the delivered file.
By making a payment to Justdata, you confirm that you understand and accept that the payment is non-refundable, and that you reviewed the data category, volume, and pricing before paying.

8.1 Exception for Proven Duplicate Payment

If you accidentally paid twice for the same order, Justdata may at its sole discretion issue a credit note or refund for the extra amount after verification. You must inform us within 24 hours of the transaction and provide documentary proof like payment receipts or bank statements. Our decision in such cases will be final.

We strongly recommend that all clients carefully check their requirements, data category, and pricing before making any payment. If you have any doubts, our team is available at support@justdata.in before you place your order.

9. DATA REPLACEMENT POLICY

Even though we do not offer refunds, we are committed to data quality. If there is a genuine problem with the data we delivered, we will replace the affected records, subject to the conditions below.

9.1 Valid Grounds for Replacement

A replacement request will only be accepted if you can prove any of the following genuine data quality issues:
  • Invalid or non-existent phone numbers that return error tones, are out of service, or simply cannot be dialled.
  • Wrong or mismatched phone numbers that do not belong to the type of audience or segment you purchased.
  • Inaccurate leads where the contact data does not match the category you purchased (for example, getting non-real-estate leads in a real estate database).
  • Data mismatch where key details like name, city, profession, or interest category are factually incorrect.
  • Duplicate entries within the delivered file that are more than a reasonable number.
Replacement requests will NOT be accepted for:
  • Leads that did not result in sales or business outcomes.
  • Contacts who were not interested in your specific product or service.
  • Data that is technically correct but did not give you the marketing results you expected.
  • Numbers that are switched off, temporarily unavailable, or not reachable.
  • Personal dissatisfaction or subjective opinions about data quality.

9.2 Time Limit to Raise a Replacement Request

You must raise your replacement request within 3 calendar days from the date your data was delivered. Requests raised after 3 days will not be considered under any circumstances.

9.3 Proof Required

To process your replacement request, you must submit clear and verifiable proof of the data quality issue. Acceptable proof includes:
  • Call Recordings - audio recordings of calls made to the contacts in the data, clearly showing the invalid number, wrong person, or mismatch, along with the specific phone number.
  • CRM Screenshots - screenshots from your CRM system showing call logs, contact status, or notes that clearly reflect the problem for specific contacts.
  • Worksheet or Excel Report - a properly filled worksheet listing the specific problematic numbers or records, with the status, reason, and date of attempt for each record.
  • Any other credible documentary evidence that our quality team accepts on a case-by-case basis.
Verbal complaints, general statements, or unproven allegations will not be accepted as valid proof. We reserve the right to verify any proof submitted and to reject requests that do not meet our standards.

9.4 How Replacement Works

Once we receive a valid replacement request with proper proof, our quality team will review and verify it. If the claim is found to be genuine, we will replace the affected data records within a reasonable time. The replacement will cover only the specific records that are proven to be defective. It will not extend to the entire database unless a majority of the data is found defective upon our independent review. Our quality team's decision on the validity and scope of the replacement will be final.

10. HOW YOU CAN USE THE DATA

The data you purchase from Justdata is licensed only for your own internal business, marketing, or commercial use. The following rules apply strictly.

10.1 Allowed Uses
  • Contacting leads for your own marketing, sales, and business development.
  • Uploading data to your own CRM system for internal use.
  • Running outbound calling, SMS, or email campaigns for your own products and services.
  • Market research and analysis for your own business purposes.

10.2 What You Cannot Do

You must NOT under any circumstances:
  • Resell, share, transfer, sublicense, or distribute the purchased data to any other person or company, whether for money or for free.
  • Use the data on behalf of a third-party client or agency without our prior written permission.
  • Use the data in a way that violates Indian laws including the Information Technology Act 2000, TRAI guidelines, and the Consumer Protection Act 2019.
  • Send bulk unsolicited messages or spam using the purchased data.
  • Use the data for anything illegal, fraudulent, harmful, or unethical.
  • Combine our data with other data sets and sell it as a product.
  • Use our data to build competing databases.
If you misuse the data in any way, you will be fully and solely responsible for all consequences. Justdata will not be responsible for anything that happens due to your misuse. If you choose to resell or share the data in violation of these Terms, you do so entirely at your own risk and Justdata has no role or liability in that.

11. INTELLECTUAL PROPERTY AND OWNERSHIP

All databases, data compilations, formats, methodologies, and processes created or used by Justdata are our exclusive intellectual property and are protected under Indian laws including the Copyright Act 1957, the Information Technology Act 2000, and other applicable laws.

When you pay for and receive data from us, you get a limited, non-exclusive, non-transferable, and revocable license to use that specific data set for the permitted purposes in Section 10. This does not mean you own the data or any intellectual property rights in it. All rights not specifically given to you remain with Justdata.

12. NO WARRANTIES

Justdata provides all data and services on an "as-is" and "as-available" basis. We do not make any promises or guarantees, including but not limited to:
  • That the data will be 100% accurate, complete, or up to date at all times.
  • That using the data will result in specific conversion rates, lead quality, or business outcomes.
  • That our website, email systems, or cloud platforms will always be available without any errors.
  • That the delivered data will be compatible with your CRM or marketing software.
Data changes over time. Phone numbers get changed, people move, and situations evolve. We cannot guarantee that data will be perfectly accurate at the moment you use it. We also do not promise that any lead in the data will result in a successful business deal or conversion. The results of any marketing campaign depend on many factors that are outside our control.

13. LIMITATION OF LIABILITY

To the maximum extent allowed under Indian law, Justdata will not be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages arising from these Terms or your use of our data and services. This includes but is not limited to:
  • Loss of revenue, profits, business, or savings.
  • Loss of goodwill, reputation, or business opportunity.
  • Failure of a marketing campaign or business disruption.
  • Any claims from third parties because of how you used the data.
  • Any regulatory penalty or legal action taken against you for your use of the data.
In any case, Justdata's total liability to you will not exceed the total amount you paid us for that specific order.

14. INDEMNIFICATION

You agree to protect, defend, and keep Justdata harmless - including our proprietors, directors, employees, agents, and affiliates - from any claims, losses, damages, legal costs, and expenses that arise because of:
  • You breaking any of these Terms.
  • The way you use or misuse the data you purchased from us.
  • You violating any law, regulation, or third-party rights.
  • Any marketing or communication activity you run using our data.
  • Any false or incorrect information you provided to us.
This obligation continues even after your relationship with Justdata ends.

15. CONFIDENTIALITY

Both parties agree to keep confidential any business, technical, or financial information shared during their dealings. You must not share Justdata's data sources, pricing, working methods, or any other non-public business information with any third party without our prior written permission. Justdata will handle your personal and business information in line with our Privacy Policy at https://www.justdata.in/p/privacy-policy.html.

16. PRIVACY AND DATA PROTECTION

Justdata takes your privacy seriously. By using our services, you agree to how we collect, use, and store your information as described in our Privacy Policy.

We collect your details like name, email, phone number, business name, and payment information only to process your orders, deliver services, and communicate with you. We do not sell or rent your personal information to any third party for their marketing purposes.

It is your responsibility to make sure that the way you use the data you purchase from us is in line with all applicable privacy and data protection laws in India or any other country where you operate.

17. FOLLOWING APPLICABLE LAWS

By using Justdata's services, you confirm that your use of the purchased data will always comply with all applicable laws and regulations, including:
  • The Information Technology Act, 2000 and its 2008 Amendment.
  • The Indian Telegraph Act, 1885.
  • TRAI Regulations including TCCCPR 2018.
  • The Consumer Protection Act, 2019.
  • The Indian Contract Act, 1872.
  • The Competition Act, 2002.
  • All other applicable central and state laws related to data usage, privacy, and digital communications.
It is entirely your responsibility to understand which laws apply to you and to follow them. Justdata does not take any responsibility for your compliance with laws in your specific industry or region.

18. WHEN WE CAN STOP OR REFUSE SERVICE

Justdata can refuse, cancel, or suspend service to any client at any time at our sole discretion. We may do this immediately and without notice if:
  • You break any of these Terms.
  • You use the data for illegal, unethical, or unauthorized purposes.
  • You behave in a fraudulent, abusive, or threatening way towards our team.
  • You raise a chargeback or payment dispute in bad faith.
  • Your activities risk exposing Justdata to any legal, regulatory, or reputational harm.
If your service is terminated because you broke these Terms, no refund will be issued and we reserve the right to take all available legal action.

19. FORCE MAJEURE

Justdata will not be responsible for failing to deliver or for delays caused by situations completely outside our control. This includes natural disasters, government actions, pandemics, power outages, internet infrastructure failures, cyberattacks, civil unrest, or any similar event. If such a situation happens, we will inform you as soon as we can and will resume services once the situation is resolved.

20. GOVERNING LAW AND DISPUTE RESOLUTION

20.1 Governing Law

These Terms are governed by the laws of the Republic of India.

20.2 Jurisdiction

Any dispute or legal proceeding related to these Terms will be handled by the competent courts in India.

20.3 Resolving Disputes Through Talks First

If there is any dispute between us, both parties will first try to resolve it through direct discussion in good faith. Either party can start this process by giving written notice to the other. We will try to resolve the issue within 30 days of such notice.

20.4 Arbitration

If the dispute is not resolved through discussion within 30 days, either party can refer the matter to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). A single arbitrator will be appointed by mutual agreement. The arbitration will be held in India and conducted in English.

21. ENTIRE AGREEMENT

These Terms, along with any order confirmation, invoice, or written agreement between Justdata and you, form the complete agreement between both parties. They replace all previous discussions, understandings, or agreements related to the same subject. No changes to these Terms will be valid unless confirmed in writing by an authorized representative of Justdata.

22. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable by a court or arbitrator, that part will be adjusted to the minimum extent needed to make it valid. All other parts of these Terms will continue to apply fully.

23. NO WAIVER

If Justdata does not enforce any right under these Terms at any point, it does not mean we have given up that right. Any past waiver of a breach does not mean we will waive similar or future breaches.

24. CHANGES TO THESE TERMS

We can update these Terms at any time at our sole discretion, without giving prior notice. Updated Terms will be effective as soon as they are published on www.justdata.in. If you continue using our services after the update, it means you have accepted the new Terms. If you do not agree, please stop using our services.

By making a payment to Justdata or placing an order with us, you confirm that you have read, understood, and fully agreed to these Terms and Conditions. You also confirm that these Terms are legally binding and that you are agreeing to them freely and voluntarily.
